These Terms of Service (“Terms”) govern your access to and use of the Smart Grocery List mobile application, website, and related services (collectively, the “Service”). “Smart Grocery List,” “we,” “our,” and “us” refer to the developer and operator of the Service.
By downloading, accessing, creating an account for, or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be legally capable of entering into a binding agreement in your place of residence. If you are under the age of majority, a parent or legal guardian must review and agree to these Terms on your behalf. The Service is not directed to children under 13.
Authentication may be provided through Google Sign-In, Firebase Authentication, or another supported provider. Your use of a third-party sign-in provider is also subject to that provider’s terms.
Subject to these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable licence to install and use the Service for lawful personal or household purposes.
You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, attempt to extract source code, bypass security features, or use the Service to build a competing product, except where applicable law expressly permits such activity.
You retain ownership of grocery lists, pantry information, notes, favourites, and other content you submit (“User Content”). You grant us a limited licence to host, store, process, reproduce, and transmit User Content only as reasonably necessary to operate, secure, synchronize, and improve the Service.
If you join or create a shared household, authorized members may view, add, edit, check off, or delete shared content. You are responsible for choosing whom you invite and for content you place in shared areas. Changes made by another authorized household member may affect everyone with access.
Do not submit content that you do not have the right to use. We may remove content that violates these Terms or applicable law.

The Service may provide grocery lists, a master or “Grand List,” favourites, pantry tools, barcode scanning, reminders, offline access, and real-time household sharing. Features may vary by device, operating system, region, app version, account status, or network availability.
We may add, modify, suspend, or discontinue features when reasonably necessary. We do not guarantee that the Service will always be uninterrupted, error-free, or compatible with every device. Offline changes may not synchronize until a connection is restored, and conflicting edits may be resolved by the Service’s synchronization process.
If paid features, subscriptions, or in-app purchases are offered, the price and billing terms will be shown before purchase. Transactions made through Google Play, the Apple App Store, or another platform are processed by that platform and are subject to its payment, cancellation, and refund rules.
Unless required by law or the applicable store’s rules, we do not directly issue refunds for purchases processed by an app store. Nothing in these Terms limits non-waivable consumer rights.
The Service may rely on third-party services such as Firebase, Google Sign-In, app stores, device notification systems, and barcode-data providers. These services are governed by their own terms and privacy practices. We are not responsible for third-party services that we do not control, but we select and use providers to support the operation of the Service.
The Service, including its software, design, branding, logos, text, graphics, and non-user content, is owned by or licensed to us and is protected by intellectual-property laws. Except for the limited licence granted in these Terms, no rights are transferred to you.
If you send suggestions or feedback, you permit us to use them without restriction or compensation, provided we do not publicly identify you without permission.
You may stop using the Service at any time. You can request account deletion through the app or by following our Delete Account instructions.
We may suspend or terminate access if you materially violate these Terms, create security or legal risk, or misuse the Service. Where reasonable, we will provide notice or an opportunity to correct the issue. After termination, provisions that by their nature should survive—including ownership, disclaimers, liability limitations, and dispute provisions—will continue to apply.
The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by law. Grocery lists, reminders, pantry records, product information, barcode results, and other outputs are organizational aids. You remain responsible for checking product labels, allergens, expiry dates, recalls, prices, quantities, dietary suitability, and purchase decisions.
The Service does not provide medical, nutritional, legal, or financial advice. We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability to the extent those disclaimers are permitted by applicable law.
To the fullest extent permitted by law, Smart Grocery List and its developer, operator, affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, profits, goodwill, or business opportunity arising from the Service.
To the fullest extent permitted by law, our aggregate liability for claims relating to the Service will not exceed the greater of: (a) the amount you paid directly for the Service during the 12 months before the claim; or (b) CAD $100.
Some jurisdictions do not permit certain exclusions or limits. In those jurisdictions, these provisions apply only to the maximum extent legally permitted. Nothing excludes liability that cannot lawfully be excluded.
To the extent permitted by law, you agree to indemnify and hold us harmless from third-party claims, losses, and reasonable costs arising from your unlawful use of the Service, your User Content, or your material violation of these Terms. This obligation does not apply to the extent a claim results from our own negligence or misconduct.
We may update these Terms to reflect changes to the Service, law, security practices, or business operations. We will post the updated Terms and revise the effective date. If a change materially affects your rights, we will provide reasonable notice through the Service or another appropriate channel. Continued use after the updated Terms take effect means you accept them.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. Subject to any mandatory rights you have under local consumer law, disputes will be brought before the courts located in Ontario, Canada.
Before starting formal proceedings, please contact us and describe the issue so we can try to resolve it informally. Nothing in this section prevents either party from seeking urgent injunctive relief or using a small-claims process where available.
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, restructuring, or transfer of the Service. These Terms and the Privacy Policy form the entire agreement concerning the Service.
